Welcome! First, here’s a snapshot of the key privacy points in our privacy policy:

  • Our App and Website help connect you with deals, information, and entertainment related to your airport layovers using information you provide and other information on your device and in your other accounts you have instructed us to consult.
  • The information the Services gather from your usage may be analyzed in aggregate to improve the product user experience or in order to publish aggregate statistics.
  • We use personal and financial information you provide through the Services to connect you with third party offers and provide you with useful information about your layover. We may personalize the offers or our user interface based on the information you have provided.
  • We don’t share your personal information with third parties for their direct marketing purposes nor sell information that identifies you as an individual.

Smart Layover Privacy Policy

 

This policy applies to the collection, use and transmission of data within the mobile application and website (collectively, “Services“) owned and controlled by Smart Layover, LLC, a Washington limited liability company (referred to in this Policy as “we” “us,” “our,” or “Smart Layover”). As used in this policy, references to “you” your” or a “user” refer to users of our Services. For more information about our services, please visit our website at www.smartlayover.com.

Our Commitment to Your Privacy

 

Thank you for visiting the Smart Layover Services. This Privacy Policy describes:

  • how and why we collect certain information from you via the Services;
  • how we use and with whom we share such information;
  • how you can access and update such information; and
  • the choices you can make about how we collect, use and share your information.

The Services are designed to help you get the most out of your layover and deliver deals related to your layover to your mobile device. In order to do this, we may ask you if we can consult other information stored on your mobile device (e.g. email, calendar, or a third party application). Please read on for details about the specific types of personal and non-personal information collected through the Services and how we use each.

 

Information We Collect

 

Non-personal Information. Like most mobile applications and web services, we may collect certain technical information about your usage, and generally this is not information that could be used to identify you without reference to other information (collectively, “Usage Information“). For example, we may collect your IP address, browser type, referring website, mobile operating system type, mobile device type, the identity of your internet service provider (ISP), and/or frequency and duration of one’s usage. This does not include demographic information about you. We track and reference your Usage Information to improve our users’ experience, avoid fraud, and help customize user experience.

Your Submissions of Personal Information. You have the opportunity to submit Personal Information to us through the App in several ways:

Registration Information. If you create an account through the Services, you may be asked to provide personal information such as your name, phone number, postal and email addresses, a home airport location, your hotel preferences, and your frequent flyer and/or car rental program enrollment information. We refer to these items collectively in this policy as “Registration Information.”

 

Billing Information. In order to reserve [and/or purchase] items or services through our Services you will need to provide a credit card number, billing address, expiration date, and security code, all of which are processed through our partnership with Authorize.net or a similar financial services provider. We refer to these items collectively in this policy as “Billing Information.”

 

Third Party-Originated Information. Our services may obtain information about you or your use of third party services engaged in connection with our own Services, for example from third party affiliates and business partners such as a hotel provider or tour service. We refer to these items collectively in this policy as “Third Party-Originated Information.” We may combine such information with other personal information we have about you. We ask your permission before using electronic means to access such information directly form a third party account, but once we have obtained your permission to access any particular account we will not separately ask your permission to access any piece of information in that account or to otherwise permit the App to interact with Third Party-Originated Information. Please do not give your permission for us to access a third party account if you do not want us to have access to the associated Third Party-Originated Information.

 

Location Information. You may allow the Services to use your location through the standard Apple location permission pop-up if you use the Services on an iPhone or by turning on “location services” on your Android phone. If you click to allow or have location services on, the Services will continue to use your location to improve the functionality available to you through the Services, for example by suggesting locations for a meeting nearby. We refer to such information gathered about your location through automatic means on your device as “Location Information.”

 

Companion Information. You can use the Services to make a reservation on behalf of another individual. If you choose to do so, we will request personal information about that individual, and you must have the consent of any such individual in order to provide that information. By providing such information, you represent and warrant that you have the necessary consent to do so. We will use such companion information to make reservations using the Services for your travel companions.

 

Cookies. For Services operate through our website, or accessed via email communications, we use cookies, local shared objects, and web beacons to facilitate our Services. Cookies are pieces of code placed on a user’s hard drive that store information about the user and his or her preferences. Web beacons are small graphics placed within a web page or email that store or provide information to us in a manner similar to a cookie. Local Shared Objects (a.k.a. Flash Cookies) are similar mechanisms that also store your settings and preferences in order to customize your experience (e.g., by storing volume settings or content delivery settings. We may use any of these technical mechanisms to, for example, keep you logged into your account, sign you into your account automatically, to customize the content delivered to you, to recognize your technical settings, to measure the efficacy or usage of our Services and to present you with information or advertisements that may be of interest. In some cases, third party advertisers may place cookies on your machine through our website to deliver targeted advertising to you. You can disable the use of cookies by updating your web browser settings, which are usually accessible through the “Help” menu of your browser. Please note, however, that if you disable cookie some of our Services may no longer function.

 

How We Use Information Collected from You

 

How We Use Your Personal Information

 

We may use the Personal Information we collect (including any information from other applications where you have consented to our accessing what is stored in that application) as follows:

  1. To connect you with service providers who would like to offer deals on services during your layover;
  2. To help reserve and/or complete your reservations for any such layover services;
  3. To provide you with updated travel schedules and flight information;
  4. To provide you with information about an airport or geographic location you’re visiting during a layover or while waiting for a flight;
  5. To manage your account, process your transactions, or communicate with you about our Services;
  6. To respond to your, questions, comments, and other feedback;
  7. To notify you about special offers and products or services that may be of interest to you;
  8. To customize your experience with the Services;
  9. To deliver rewards, or to inform third parties that rewards are warranted, in connection with any loyalty or frequent user program integrated into our Services;
  10. To ask for additional relevant information from you in connection with the Services;
  11. To populate and maintain a log of the services you have purchased or engaged through Smart Layover;
  12. To resolve disputes, collect fees, or troubleshoot issues in connection with your use of the Services;
  13. To prevent unlawful, unfair, or abusive activities through the Services;
  14. To enforce our Terms of Service or protect the privacy and security of our other users; and
  15. To use your information in other ways that may be described to you at the point of collection.

Specifically, we may use your Billing Information (including by communicating it to our financial processing partner) in order to allow you to purchase third party products and services through the Services, complete your bookings and reservations through the Services, to authenticate and process your payments for such services, to issue refunds or apply discounts, to respond to your customer service inquiries, or to track your payment history.

From time to time we may also use Personal Information gathered through the Services (at times, in combination with Usage Information) to generate aggregate reports about our usage or partnership performance (“Reports“). These reports use anonymized, aggregate data generated by consulting your personal information, and are constructed to avoid the identification of any particular individual within the data set. Such Reports may be shared with advertisers or prospective investors.

Through the services, you are able to review our partners and other service providers and submit feedback about those services. When you do so, your name, username, purchases, or location and the feedback you have provided may be displayed publicly within the Services. You should not post any reviews or feedback about a provider unless you consent to the public display of that feedback in association with your name, username, purchases, or location.

 

Sharing of Your Information

 

Unless we obtain your consent, we will not share your Personal Information with third parties other than as provided in this Privacy Policy. However, your cellular data provider will have access to information generated by the Services to provide you with mobile service. We may share your Personal Information with third parties in one or more of the following ways:

 

Our Suppliers

You can use the Services to engage with third parties, and when you have the opportunity to do so we will indicate that a third party is involved by displaying its name and/or logo within the Services.

We will share your Personal Information with service providers such as hotel, airline, car rental, and activity providers, who in turn fulfill your travel reservations. We make efforts to limit the types of personal information we share to the particular types required by the applicable supplier; for example, we would not share your email address with such a third party unless it is required to fulfill your reservation for their services, and in that case we make efforts to secure contractual restrictions on their use of such information. However, we would not generally use contractual restrictions to prevent such suppliers from using information, such as your name, that was or could be gathered directly through their dealings with you. Please carefully review the terms of service and privacy policies of third parties you engage through the Services, as those terms and policies will apply to their handling of your information.

Please note that these suppliers may contact you using information obtained from us where necessary to obtain additional information about you, facilitate your travel reservation, or respond to a review you may submit.

 

Your Requests

You can use the Services to send notices about your reservations or other plans to travel companions, in which case identifying information about you will be sent to the people you ask that we contact. We may also share your Personal Information where you have requested our assistance, within the permitted thirty day time period, in resolving disputes with other service providers engaged in connection with our own services or as otherwise warranted in responding to your customer services inquiries.

 

Affiliates

We may share your Personal Information and Non-Personal Information with any parent or subsidiaries, or other companies or entities that control, are controlled by or are under common control with us, in which case we will require such parties to honor this Privacy Policy with respect to such shared information.

 

Third Party Service Providers

We may provide your Personal Information and Non-Personal Information to third party companies to perform services on our behalf, including e-mail delivery, web analytics, customer service, marketing, hosting services, data backups, distribution of incentive programs or surveys, user interface customization and data analysis. We may also use independent contractors to provide services on our behalf and they may have technical access your Personal Information in the course of providing those services as well. We require such third party service providers to agree contractually to maintain the confidentiality of the information disclosed to them and to not use your Personal Information for any purpose other than to provide services to us.

 

Safety, Security and Compliance with Law

We may disclose any information, including Personal Information, we deem necessary to comply with any applicable law, regulation, legal process or governmental request, to enforce our rights, or to protect the safety and security of our Services or other users.

 

Business Transaction

In the event we undergo a business transition, such as a major investment transaction, merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer your Personal Information to the actual or intended investor or successor organization in such transaction or permit its examination under confidentiality restrictions by our counterparty. If material changes to our privacy practices will occur as a result of the business transition, we will make a reasonable attempt to notify you by posting a notice within the Services and/or by sending you an email alerting you to the business transition.

 

Other Third Parties

This policy describes how we may share your personal information obtained through your use of our Services, as well as how you can opt-out of such sharing in the “How to Access and Update Your Personal Information” section, below. We are therefore in compliance with the requirements of California Civil Code 1798.83.

 

How to Access and Update Your Personal Information

 

During your interactions with our Services, you can decline to provide us with particular items of Personal Information, such as a credit card. While we do not strictly require you to provide any item of personal information in order to access our services, please be advised that certain features may not be available to you without some personal information (for example, we will need your billing information to process transaction with our partners or make reservations on your behalf).

You can add or update certain of the information we have about you through the Services at your member profile page on our website. You can visit your member profile page on our website to update your email preference with respect to our communications about offers and services of interest, or you can opt-out through a link in the emails themselves; please note, however, that we may still contact you via email about your account even if you choose not to receive offers. You can choose to provide a mobile number to receive updates about your flights and reservations from us, but you can discontinue these alerts at any time by deleting Alerts from Alerts list from application.

At any time, you may contact us to request that we make changes to your Personal Information or delete your account entirely. If you contact us to request that we delete your account, we will delete your Registration Information within thirty days (we retain records for the first 30 days after termination to ensure that all transactions through the Services have been closed).

How We Secure Your Information

 

Smart Layover uses reasonable administrative, technical, and physical security measures to protect user’s Personal and Non-Personal Information, online, offline, and in cloud storage. When you use our Services in conjunction with a third party account, the applicable third party controls transmissions to and from its servers, including any security on those transmissions.

We use third party service providers to host and/or process some of our services and we may change cloud providers at any time without updating this policy or notifying you specifically. Generally we select hosting, backup, and other service providers who store information we send to them behind firewalls or similar mechanisms.

Transmissions between our Services and our servers are conducted over HTTPS. Transmissions to and from third party accounts are secured according to the standards used by those accounts.

Our employees are generally subject to restrictions that limit their use of information obtained from us to what’s necessary to serve you or improve the App.

While we take reasonable precautions against possible security breaches of the Services, our customer databases, and records, no Internet transmission is completely secure, and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We urge you to take steps to keep your Personal Information safe (including your Registration Information and Third Party Account Information), and log out of your accounts after use, if applicable.

 

Our Policies Concerning Children

 

The App is not intended for children under the age of 13 and we do not knowingly collect any Personal Information from such children. Children under the age of 13 should not use the Services at any time. In the event that we learn that we have inadvertently gathered Personal Information from children under the age of 13, we will use our best efforts to erase such information from our records.

 

Changes to Our Privacy Policy

 

If we decide to make material changes to our Privacy Policy, we will notify you by either placing a notice within the Services or sending you an email notification.
